Imogen explains that while an employer cannot make an employee stay, they can have restrictive covenants in place to protect the business from employees who set up in competition, solicit parents or poach staff. However, these covenants must be carefully considered and should be reviewed by a professional.

As for reclaiming the cost of a qualification, Imogen explains that this can only happen under certain circumstances, such as if the employee voluntarily asked to do the course and was made aware that a clawback agreement would be in place if they left within a certain timeframe.

The clawback agreement should be agreed before the training starts and should detail the costs that can be recovered. Imogen also notes that training time and study time cannot be reclaimed, and co-funding arrangements cannot be reclaimed either. She concludes that the best way to deter employees from leaving is to create an amazing workplace culture where employees feel invested, valued, and rewarded with professional development opportunities.
